Islamabad Property News:Delay in Kashmir Highway construction poses threats to commuters

ISLAMABAD – The Capital Development Authority (CDA) chairman seems least interested in ensuring the timely completion of the Kashmir Highway project, which has almost come to a halt due to non provision of funds by the authority, Pakistan Today learnt.
The delay in construction of the Kashmir Highway has also been posing threats to the lives of those people who routinely travel on the under-construction Kashmir Highway.
According to sources, CDA has discontinued the funds for the construction project so the contractors have also slowed down the pace of the work. According to official CDA sources, less than half of the Kashmir Highway construction work has been done so far due to the lack of funds. Moreover, the developers have also been reluctant in continuing the work, causing delay in the mega project and nuisance to the commuters.
“Last week I was going to my home in Taxila when suddenly my cab went into a ditch on Kashmir highway, after which I lost control of my vehicle, which further hit a rock lying on the edge of the highway, resulting in great damage to my taxi,” said Ghulam Mahmood, a taxi driver. He said that his taxi was at the workshop and he had been unable to earn a livelihood for some days now , however what disturbed Mahmood the most was who was responsible for his loss.
Like the taxi driver, Ghulam Mahmood, there are many others who have been involved in similar incidents on the under-construction road, where many people have been injured and their vehicles damaged. However, the CDA has not taken any steps for the safety of the commuters and seems least bothered in expediting the construction work also. Therefore, the civic body’s negligence has been a cause of trouble to many commuters.
On Thursday night, another car faced a similar situation when the driver lost control of the vehicle and it hit a rock when passing by a CNG station on the highway. The police and emergency vehicles rushed to the spot. Fortunately, the driver’s life was safe, however the car was completely damaged.
Deep holes have been dug on the Kashmir Highway as part of the construction process, however the management has not placed any warning signs around such places, posing great risk to the commuters’ lives.
The Rs 3 billion dual carriageway project, under which the road will have five lanes on either side from Golra Mor to Peshawar Mor, is being constructed under the Public Sector Development Programme (PSDP). The Kashmir Highway is being widened mainly to provide fast access to the new airport being established in Fateh Jang, around 30 kilometres from the capital.
Nevertheless, the negligence of some concerned officials of the authority has created a number of hurdles in the timely completion of the project. The officials of the Civil Aviation Authority (CAA) and the CDA have dubbed the highway project the “future lifeline” of Islamabad as it will provide new links between the capital and the new airport and the Lahore and Khyber Pakhtunkhwa motorways.
A wholesale market has also been proposed in Sangjani, near the new airport, for trade activities in the northern region and Punjab. Under the plan, an interchange will be constructed at the Kashmir Highway – GT Road junction to divert traffic from the Kashmir Highway to the motorway and GT Road.

Land for lawyers’ colony ordered

MIANWALI, Jan 25: The Lahore High Court has ordered allotment of 225 kanals of land for establishment of a residential colony for lawyers near PAF Road here.

The District Bar Association had initiated its effort for the establishment of a residential colony many years ago. In 1986, the then deputy commission earmarked 225 kanals out of a chunk of land measuring 525 kanals near PAF Road but final allotment could not be made as the matter remained pending with the revenue department and the Board of Revenue.

In 2010, the Punjab government decided to sell state land to meet its financial needs and the same 525-kanal chunk of land was
placed on the sell-off list.

The DBA president filed a writ petition before the Lahore High Court to stop the auction of the said land and instead order establishment of a residential colony for lawyers.

On Wednesday, Justice Khalid Mehmood Khan accepted the petition and ordered that 225 kanals of land earmarked for the purpose in 1986 be allotted to the DBA at the rate of Rs10,000 per marla. The court also formed a committee consisting of the colonies department secretary, DCO and the DBA president to oversee the implementation of the order within six months.

The bar members have praised the efforts of DBA president Zafar Iqbal Khan as well as former presidents Sanaullah Khan and Sikandar Khan in this regard.

Land dispute cases on the rise in twin cities

* 953 cases of land dispute registered in lower courts in last four months

ISLAMABAD: The land mafia is operating scot-free in the twin cities, resulting in an increase in the number of cases of land disputes.

As many as 953 such cases have been registered in lower courts in the last four months (October 2011-January 2012).

The record of these courts revealed that 3,684 cases of land dispute were registered during January 2010-September-2011 – the majority of cases were registered against private housing societies. It has been revealed that a landowner often sells his or her property to three or four persons separately. The court of Senior Civil Judge Mahmood Haroon received 229 cases of land dispute in the last four months. Of these cases, 172 were from the rural areas of capital.

The court of Additional Sessions Judge (ASJ) Yar Muhammad Gondal registered 167 cases of land dispute during the period – 138 cases were reported from rural areas and the rest from urban areas.

The court of ASJ Kamran Bashrat Mufti registered 112 cases; ASJ Wajahat Hussain 218, Civil Judge Shabana Hameed Mughal 121 and Civil Judge Nadeem Anjum registered 106 cases of land dispute.

Generally, land-dispute cases take ages to be resolved. Such cases can even continue from one generation to the next. This situation results in hopelessness among petitioners. The majority of land disputes are witnessed in relatively less developed areas. Satellite Town, Jhangi Sayedian, Alipur Farash, Phulgaran, Bhara Kahu and Sihala are among places where cases of land dispute are high in number.

According to law, sale of real estate in the country normally takes place through a document called Sale Deed. However, such a document is not needed for the sale and purchase of real estate in the Defence Housing Authority (DHA). In some cases, people may opt for executing an agreement to sell a property even before the execution of the Sale Deed.

Also, before purchasing real estate, complete and thorough search in respect of title of the seller to the real estate must be carried out. A general practice is to investigate title of the current seller and any previous owner(s) for the last 20 years. The original title document in favour of the vendor must be obtained along with other relevant documents including mutation in favour of the vendor, a fresh copy of fard, aks shajra and an NOC.

District court nazir, Muhammad Riaz, told Daily Times that cases of land dispute are comparatively more complicated than other criminal cases due to lack of concrete evidence. He said absence of lawyers and witnesses is also a factor that contributes to delay in verdicts. “When the parties concerned do not appear before court, we are bound to delay a case until next hearing,” he said.

LAHORE – Despite the enthusiastic inauguration of the Fort Road Food Street, four food streets proposed at different locations in the city are on a choppy course and there is a chance that the idea could be dropped.
Punjab CM Shahbaz Sharif envisaged opening nine food streets, of which one was inaugurated last week. However, work on four of the remaining food streets was prohibited by Lahore Development Authority for one reason or the other.
Sources in LDA revealed that Town Municipal Administration Gulberg and DO (planning) had sought No Objection Certificates (NOCs) for the development of food streets at Model Town Extension (R-bloc), Moon Market (Gulshan Ravi), Moon Market ( Allama Iqbal Town) and Shahdara Town. However, LDA struck down the move by denying to handover its land to raise food streets, sources added. Sources said some days back, LDA Chairman Ahad Cheema had already rejected the proposal to build Food Street at Kareem Block and also refused to allocate space for four other food streets.
During the LDA governing body meeting recently held with Cheema in the chair, the issue was discussed in detail and finally it was decided that land would not be provided.
Senior LDA official told Pakistan Today that even before the approval of competent authority, some people started constructing the shops in the name of Food Street at Model Town Extension. In connivance with racket of traders, some officials of City District Government Lahore also built 20 shops at 30 feet wide road in hurry near Girls Higher Secondary School, he added.
Local residents, after registering the complaints at LDA, moved the court and got a restraining order. Meanwhile during LDA governing body meeting, LDA official objected to the construction of a food street at Model Town Extension, arguing that it would interrupt flow of traffic at the area.
LDA chief town planner also opposed the construction of Food Street in the Moon Market Park (Gulshan Ravi scheme Mor) that would cover the 50 feet wide road, adding that it could create problems for the locals. Moreover, he also said LDA could not provide land to CDGL for parking because of its proximity to a mosque and a petrol pump.
Traffic congestion was also cited as the reason for the turning down of another proposal of the development of Food Street on main road of Allama Iqbal Town near Moon Market. Alternative place was sought but it was again rejected on land transfer issue. CDGL also recommended a Food Street at the site of Bus Stop in Shahdara Town but LDA rejected it saying that the bus stop land could not be used for the development of food streets and other purposes. The proposal was rejected and the case is pending in LDA tribunal.
It may be recalled that once food street plan hit the snags when some months back LHC issued a restraining order against setting up a food street on a green belt in Shadbagh locality near Toka Wala Chowk.
CDGL officials marked Shadbagh to develop first Food Street on green belt. Local traders and people staged protest demonstration to save the green belt. Later, a petition was filed in the Lahore High Court challenging the plans to set up a food street after removing a green belt from the area.
Petitioner told the court that the Parks and Horticulture Authority (PHA) had planned to convert a green belt in Shadbagh Scheme-II area into a food street. He said this was a violation of a superior court’s orders.
A senior PHA official told Pakistan Today that in exercise of the power conferred under Section-44 of Punjab Development of Cities Act, 1976 read with government notification No SO (P) 3-4-/ 98 dated 21 September 1998, PHA framed its regulation regarding upkeep of the green strips and could convert green belts for another purpose of public utility, if extremely needed.

LAHORE – The Lahore Development Authority has proposed over a dozen new development projects for the provincial capital including construction of Moon Market Parking Plaza by generating funds from its own resources and other nine out of 10 parking plazas in partnership with the private sector, an insider informed this scribe on Monday.

Moreover, he said mostly ongoing projects were likely to be completed during the current fiscal year for which the authorities allocated billions of rupees with releasing funds for some important projects which were likely to be started by the end of this month or first week of February.

The source further said the higher authority also decided to establish a directorate for monitoring the status of development works in the private housing schemes, approved by LDA, for ensuring speedy completion of these works for the convenience of the allottees.

“The LDA will arrange funding for the under-construction commercial-cum car parking plaza at Moon Market, Allama Iqbal Town, through LDA’s own sources by carrying out the sale of 67 shops in the plaza simultaneously to earn more revenue for this purpose”, the source added.

He said the provincial government although promised to provide funds for the construction of such parking plazas but later government back out of its promise and refused to provide funds for this purpose, resultantly the LDA had to defer the construction of such parking plazas for indefinite period.

Chief Minister Shahbaz Sharif, while addressing the inauguration ceremony of Liberty parking plaza, had promised the citizens that his government would construct 10 more parking plazas for the convenience of the Lahorites.

“Now the LDA is going to restart work on such under-construction parking plaza by the end of this month or first week of February and the authorities will have to generate funds for the construction of such plaza from its own resources as per direction of the provincial govt,” he said adding the department was also planning to start work on other nine proposed parking plazas in partnership with the private sector.

The LDA authorities have also gave a go ahead for the construction of pedestrian overhead bridge at Moulana Shoukat Ali Road in front of Jinnah Hospital at a cost of Rs 37.226 million.

It also approved the proposal for construction of a slip road connecting Bahawalpur Road with Lytton Road at Qartaba Chowk besides carrying out rehabilitation of Maulana Shabbir Usmani Road from ‘Y’ junction New Garden Town to Faisal Town roundabout at a cost of Rs 136.88 million.

The governing body of CDGL, in it’s meeting, held a couple of weeks ago also approved the revised estimates for improvement and rehabilitation of Ferozepur Road from Qartaba Chowk to Khaira Distributory, Chungi Amer Sidhu, at a cost of Rs 172.791 million.

Besides construction of Ghazi Road T-Junction and provision of entry/exist ramps from Qainchi Intersection to Khaira Distributory, remodeling of General Hospital Intersection and development of parking from Qainchi Junction to Khaira Distributory will be carried out under this project.

The authorities also allowed construction of sports club at 108-Ravi Road at a cost of Rs 58.226 million. It will provide recreational and sports facilities to the public.

Initially, the CDGL and LDA authorities allotted two chunks of land to the health department for setting up two hospitals in the City.
